Please read these Terms and Conditions (these "Terms") carefully before booking a session with GuardianPlay. These Terms govern your use of and access to GuardianPlay's digital safety supervision services, including all related sessions, reports, communications, and documentation.

By completing a booking form, providing consent, and making payment, you agree to these Terms in full. If you do not agree to these Terms, you must not book or use GuardianPlay's services.

GuardianPlay is operated by Ann Margarette Gonzales, a sole proprietor registered in the Republic of the Philippines (DTI Registration No. [XXXXX]). References to "GuardianPlay", "we", "us", or "our" in these Terms refer to this business.

References to "you" or "the client" refer to the parent or legal guardian who books a session. References to "the child" refer to the minor who participates in the session.

Service

The live, scheduled, human-supervised online gameplay sessions provided by GuardianPlay, together with post-session security reports and all related communications.

Session

A single scheduled and paid supervision period during which a session guardian joins and monitors a child's online gameplay on a supported platform.

Session Guardian

A trained individual employed or contracted by GuardianPlay to conduct supervision during a session. Session guardians are not childcare workers, therapists, or educators.

Platform

A third-party online gaming service on which sessions are conducted, including Roblox, Minecraft, and Fortnite. GuardianPlay has no affiliation, endorsement, or contractual relationship with any platform operator.

Security Report

The post-session written report delivered to the parent or guardian within 24 hours of each session, documenting observations, any incidents, and actions taken.

Bundle

A prepaid package of multiple session hours purchased at a discounted rate as set out in our pricing schedule.

Retainer

A monthly recurring prepaid agreement for a fixed number of session hours per month, at the rates specified at the time of agreement.

3. The Service We Provide

GuardianPlay provides live, human-supervised digital safety sessions during children's online gameplay on supported platforms. The service includes real-time monitoring, guided interaction (depending on the selected tier), and a structured post-session security report.

GuardianPlay is not and does not provide:

  • Babysitting or childcare of any kind

  • Therapy, counselling, or any form of mental health support

  • Educational tutoring or academic coaching

  • Gaming coaching or skill development

  • A substitute for parental supervision or parental responsibility

  • A guarantee that all risks in online gaming environments will be eliminated

The Service is delivered entirely online. GuardianPlay operates from the Republic of the Philippines and has no physical presence in the client's country.

How to think about this service: GuardianPlay is to online gaming what a swimming supervisor is to a public pool — a trained, watchful presence that improves safety without replacing the responsibility of parents, or the rules of the facility.

4. Eligibility and Parental Authority

To book and use GuardianPlay's services, you must:

  • Be at least 18 years of age

  • Be the parent or legal guardian of the child named in the booking

  • Have full legal authority to provide consent for the child to participate

  • Have read and agreed to these Terms, the Privacy Policy, and all consent checkboxes in the booking form

  • Provide accurate and complete information at booking

By completing the booking form, you represent and warrant that all of the above conditions are met. GuardianPlay reserves the right to cancel a booking without refund if any representation is found to be false or misleading.

Sessions are available to children who are able to follow basic instructions and participate in a guided online environment. GuardianPlay reserves the right to end a session where a child is unable or unwilling to cooperate with safety guidelines, with no refund applicable.

5. Booking, Payment and Confirmation

Booking Process

Sessions are booked through the GuardianPlay booking form on our website. A booking is not confirmed until all of the following are complete: the booking form is submitted, all consent checkboxes are agreed to, and payment is received in full.

Pricing

Promotions are communicated to clients through correspondence like email, website, social media postings.

Payment

All payments are processed securely via Paypal Secured Payment Portal. Payment must be completed in full before a session is confirmed. GuardianPlay does not store card details. All prices are in USD unless otherwise stated.

Confirmation

You will receive a booking confirmation email to the address provided at booking. If you do not receive a confirmation within 2 hours of payment, contact hello@guardianplayservices.com immediately.

6. Session Rules and Conduct

Parent responsibilities during a session

  • You must remain reachable by your chosen contact method for the full duration of the session

  • You must ensure your child is ready to participate at the agreed session time

  • You must ensure your child has a valid, active account on the relevant platform

  • You must not instruct the session guardian to violate platform terms of service

Guardian conduct standards

  • Session guardians use only GuardianPlay-designated accounts — never personal accounts

  • All communication is limited to the booked session only

  • No off-platform contact, personal details, or ongoing relationships are maintained

  • Any temporary in-game connections (e.g. friend requests) are removed immediately after every session

  • Guardians never promise confidentiality to a child or ask a child to keep secrets

Guardian rights

  • Mute or block any player whose behaviour poses a risk to the child

  • Move the session to an alternative server

  • End the session early if the environment cannot be made safe

  • End the session early if the child repeatedly refuses to follow safety guidelines

The session guardian may, without prior notice and without refund obligation:

Non-refundable early termination: Sessions ended early for child safety reasons or persistent non-compliance with session guidelines are non-refundable. This is a safeguarding rule, not a penalty.

7. Cancellation and Rescheduling

To cancel or reschedule, email hello@guardianplayservices.com with your booking reference and the session date and time. Cancellations are effective from the time of our written acknowledgement.

8. Limitation of Liability

Please read this section carefully. It limits GuardianPlay's legal liability. Nothing in this section limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law in your jurisdiction.

To the fullest extent permitted by applicable law, GuardianPlay, its operator, and any engaged session guardians shall not be liable for:

  • Any exposure to inappropriate content originating from other users on third-party platforms

  • Any technical failure, outage, or change to a third-party platform (including Roblox, Minecraft, or Fortnite)

  • Any incident, interaction, or harm arising outside the boundaries of the scheduled and paid session

  • Any indirect, incidental, special, consequential, or punitive damages of any kind

  • Any action taken by a platform operator in response to platform-related activity

  • The behaviour of other players or users on any gaming platform

Total liability cap: GuardianPlay's maximum total liability to any client arising from any single session or series of sessions shall not exceed the total fees paid by the client for those sessions.

GuardianPlay does not warrant that the Service will be uninterrupted, error-free, or that all online risks will be eliminated. Online gaming environments are third-party systems beyond GuardianPlay's control.

9. Safeguarding and Mandatory Reporting

GuardianPlay applies a structured, three-level safeguarding protocol during every session.

Level 1 — Low Risk

Minor incident managed within session

Examples: mild language from other players, minor unsolicited friend request. Action: mute/block, redirect child, document, include in post-session report.

Level 2 — MODERATE Risk

Session environment compromised

Examples: persistent harassment, child distress, unmanageable public server. Action: server change or early session end, parent notified within 2 hours, expedited report same day.1313

Level 3 — high risk

Immediate threat to child safety

Examples: explicit grooming attempt, sexual content directed at child, child discloses abuse. Action: immediate session end, evidence preserved, parent contacted within 30 minutes, platform reported.

Mandatory reporting override: In circumstances where a child's immediate safety requires it, or where applicable law in the child's country creates a mandatory reporting obligation, GuardianPlay may report to relevant child protection authorities or law enforcement without prior parental notification. By booking a session, you acknowledge and accept this override as a condition of the Service. This is a safeguarding obligation, not a breach of these Terms.

10. Platform Dependency

GuardianPlay's services are delivered on third-party platforms including Roblox, Minecraft, and Fortnite. You acknowledge and accept that:

  • GuardianPlay has no contractual relationship with, and is not endorsed by, any platform operator

  • GuardianPlay cannot control, modify, or guarantee the availability, content, or behaviour of any platform

  • Platform outages, technical failures, or changes to platform terms of service may affect session delivery

  • Your child must have a valid, compliant account on the relevant platform before the session begins

  • GuardianPlay is not responsible for any action taken by a platform against your child's account

  • If a platform change makes delivery of the Service impossible, a full refund or reschedule will be offered

11. Intellectual Property

All session security reports, session notes, and documentation produced by GuardianPlay remain the intellectual property of GuardianPlay. These documents are shared with the relevant parent or guardian for their personal use only.

You may not reproduce, publish, share publicly, or use session reports for any commercial purpose without GuardianPlay's prior written consent.

The GuardianPlay name, logo, brand identity, and all website content are the property of GuardianPlay and may not be reproduced without permission.

12. Termination

GuardianPlay reserves the right to terminate a client relationship immediately and without refund for any of the following reasons:

  • Provision of false or misleading information at booking

  • Persistent non-compliance with session guidelines

  • Abusive, threatening, or inappropriate behaviour toward a session guardian

  • Attempting to circumvent booking, payment, or consent processes

  • Any behaviour that undermines the safety of a session guardian or the child

You may terminate your relationship with GuardianPlay at any time by ceasing to book sessions. Cancellation terms in Section 7 apply to any prepaid sessions.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines.

For clients in the United States, United Kingdom, European Union, Australia, and Canada: nothing in this clause removes or limits any statutory consumer rights or protections that you hold under the laws of your own jurisdiction and that cannot be contractually waived.

Dispute resolution: In the event of a dispute, both parties agree to attempt resolution in good faith by email at hello@guardianplayservices.com within 30 days before initiating any formal legal process. Most concerns can and should be resolved through direct communication.

14. Changes to These Terms

GuardianPlay may update these Terms from time to time. We will notify active clients by email at least 14 days before any material changes take effect. The current version is always published at [guardianplay.com/legal].

Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must cease using the Service and contact us regarding any prepaid sessions.
